KaziKazi Terms of Service

These Terms of Service (“Terms”) govern your use of the KaziKazi mobile app and the website at https://kazikazi.africa (together, the “Service”). They are a legal agreement between you and [FILL: legal entity name — e.g. “BetaKazi Limited” trading as “KaziKazi”, company registered in Kenya under company number FILL, registered office FILL] (“KaziKazi”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
These Terms work together with our Privacy Policy and Community Guidelines. Read those too — they apply to you in the same way.
1. Plain-English summary
- KaziKazi is a marketplace. People who need help (Posters) post tasks (“kazis”). People who want to do tasks (Workers) accept and complete them. You contract directly with the other party. KaziKazi is not the employer, contractor, or party to that contract — we are the platform that connects you and holds the money safely until the kazi is done.
- We hold the money in escrow. The Poster pays first; we release funds to the Worker after the kazi is completed and accepted.
- We charge a platform fee of 20% on each transaction.
- You must be 18+ to use KaziKazi.
- Be honest, be safe, and follow the Community Guidelines.
- Disputes go through our in-app process first. If we can’t resolve them, Kenyan courts have jurisdiction.
2. Eligibility
To use KaziKazi you must:
- Be at least 18 years old.
- Have legal capacity to enter into binding contracts under Kenyan law.
- Provide accurate identity information (name, phone number, selfie).
- Use the Service only for lawful purposes.
- Not be subject to any sanctions or otherwise prohibited from using the Service.
We may at any time ask you to verify your identity (for example, by uploading a current selfie or providing additional documents). We may suspend or terminate your account if you fail or refuse.
3. Your account
3.1 One account per person
You may have only one KaziKazi account. Multiple accounts may be merged or terminated. Selling, sharing, or transferring an account is prohibited.
3.2 You are responsible for your account
You are responsible for everything that happens under your account, including kazis you post or accept, payments you authorise, and content you share. Keep your phone number secure and tell us immediately if you suspect unauthorised use.
3.3 Account suspension and termination
We may suspend or terminate your account at any time if:
- You violate these Terms or the Community Guidelines.
- You provide false information.
- We are required to do so by law.
- We reasonably believe your account is being used fraudulently or to harm others.
You can delete your account at any time from inside the app (Profile → Delete account). The retention rules in our Privacy Policy §6 apply.
4. The marketplace — how it works
4.1 What KaziKazi is
KaziKazi is a technology platform that connects Posters and Workers. We:
- Facilitate the discovery, communication, agreement, payment, and rating of kazis.
- Hold the agreed price in escrow until the kazi is complete.
- Provide dispute-resolution processes for transactions made through the Service.
4.2 What KaziKazi is not
We are not:
- A party to the agreement between Poster and Worker.
- The employer of any Worker. Workers are independent contractors, not employees of KaziKazi or the Poster (unless the Poster and Worker explicitly agree otherwise outside the Service, in which case those terms are between them).
- A guarantor that any kazi will be completed to your satisfaction.
- A licensed employment agency, recruitment business, financial institution, transport operator, or healthcare provider.
We don’t supervise the performance of kazis. We don’t verify the qualifications of Workers beyond what they self-declare. We don’t inspect physical work.
4.3 Tax and your own obligations
You are responsible for your own taxes. KaziKazi can generate KRA-formatted tax reports if you provide your KRA PIN, but you remain responsible for filing and paying any taxes owed under Kenyan law.
You are responsible for any licences, permits, insurance, or other authorisations required for the kazis you post or accept. KaziKazi does not verify these.
5. Posting and accepting kazis
5.1 Posters
When you post a kazi, you confirm:
- You have the right and authority to ask for the work.
- The description, location, and price are accurate.
- The kazi complies with Kenyan law and the Community Guidelines.
- You will pay the agreed amount via the Service’s escrow system.
- You will treat the Worker with respect.
5.2 Workers
When you accept a kazi, you confirm:
- You have the skills, equipment, and legal capacity to perform it.
- You will perform it in good faith, honestly, and safely.
- You will communicate with the Poster through KaziKazi chat.
- You will provide completion proof (photo + location stamp) when the kazi is done.
- You will treat the Poster and any third parties with respect.
5.3 Direct dealing
You may not pay or be paid for a kazi outside the Service in order to avoid platform fees (“off-platform dealing”). If we detect this, we may suspend or terminate accounts involved.
6. Payments, escrow, and fees
6.1 Escrow
For paid kazis, the Poster pays the agreed amount via Paystack or M-PESA into a holding balance (“escrow”) at the time of acceptance. We do not release funds to the Worker until:
- The Worker submits completion proof, and
- The Poster confirms completion (or a defined automatic release happens — see §6.4).
We act as the escrow holder as a service to both parties; we do not earn interest on escrow balances and we do not lend or invest your money.
6.2 Platform fee
KaziKazi charges a platform fee of 20% on the gross kazi price. The fee is deducted from the amount Posters pay; Workers receive the price net of the fee. The current fee at the time of posting is shown in-app and is final for that kazi.
6.3 Payouts
Payouts to Workers are made via Paystack to the M-PESA number or bank account you have verified. Payouts typically arrive within [FILL: 1 business day] of release but timing depends on Paystack and your bank/mobile-money provider — we cannot guarantee a specific time.
6.4 Automatic release
There is no automatic release of escrowed funds. Once the Worker submits proof of completion, the Poster reviews and confirms in-app to release the payment. If the Poster does not respond, funds remain in escrow and KaziKazi reviews the kazi manually before deciding to release the funds to the Worker, refund the Poster, or invite both parties into a dispute. Manual review timelines are not guaranteed, but we aim to act within a reasonable period after completion proof is submitted. If the Poster opens a dispute before we release funds, see the Disputes section below.
6.5 Refunds
- Before a Worker accepts — full refund.
- After acceptance, before completion — partial refund may apply depending on time and effort already invested. Posters and Workers should agree in chat; if they cannot, the dispute process in §7 applies.
- After completion is confirmed — no refund, except where the Worker did not actually do the work or the work was materially fraudulent.
6.6 Failed payments and chargebacks
If a payment fails, the kazi is cancelled and any held funds are returned. If a Poster initiates a chargeback through their bank or mobile-money provider after a kazi was completed, we may suspend the account and pursue the amount owed. Chargeback fees (if any) charged by Paystack to KaziKazi may be added to what is owed.
6.7 Prices and currency
All prices are in Kenyan Shillings (KES) unless otherwise stated.
7. Disputes
If you have a problem with a kazi:
- Talk in chat first. Most problems are misunderstandings — chat to the other party in the kazi thread.
- Open a dispute in-app. From the kazi screen, tap “Report a problem”. Describe the issue and attach evidence (photos, screenshots).
- KaziKazi review. Our team reviews the evidence within [FILL: 5 business days] and proposes a resolution. We may:
- Release funds to one party.
- Split the funds.
- Refund the Poster.
- Suspend an account.
- Final review. If you disagree with our decision, you may request one further internal review within 14 days.
- External resolution. Either party may pursue the matter through Kenyan courts after the internal process is exhausted (see §13).
We try to be fair, but we are not a court — our resolution is binding for the in-app dispute but does not prevent either party from seeking external legal remedies.
8. Ratings and reviews
After a kazi, both parties may rate each other (1–5 stars plus optional metrics). Ratings:
- Become part of the rated party’s reputation visible to future counterparties.
- Cannot be deleted on request, except where they violate these Terms or the Community Guidelines (e.g. obscenity, threats, false claims).
- Belong to the rater (their honest opinion) but become part of the rated party’s record. We retain the right to remove a rating that we determine to be retaliatory or abusive.
9. Acceptable use
You agree to follow the Community Guidelines. In short, you must not use the Service to:
- Break Kenyan law.
- Harass, threaten, or discriminate against another user.
- Post or perform kazis involving illegal goods, weapons, drugs, sexual services, or anything prohibited by the Community Guidelines.
- Defraud, deceive, or impersonate any person.
- Reverse-engineer, scrape, or attempt to access the Service in unauthorised ways.
- Resell, redistribute, or commercialise data obtained from the Service.
- Use bots, scripts, or automated tools without our written permission.
- Interfere with the Service’s operation (DoS, exploits, etc.).
Violations may result in immediate suspension and forfeiture of any pending payouts to the violating account.
10. Content you submit
You retain ownership of any content you submit (photos, messages, kazi descriptions, ratings). You grant KaziKazi a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content only as needed to run the Service (showing it to the counterparty, supporting disputes, retaining it under §6 of the Privacy Policy).
You confirm that any content you submit:
- Is yours to share, or you have permission to share it.
- Does not violate anyone’s rights, including privacy and intellectual property.
- Does not contain harmful or illegal material.
We do not pre-screen content. We may remove content that violates these Terms or the Community Guidelines after we are made aware of it.
11. KaziKazi’s intellectual property
The KaziKazi name, logo, app, website, designs, and software are owned by [FILL: BetaKazi Limited] and protected by copyright, trademark, and other laws. You may use them only as needed to use the Service. You may not copy, modify, or build derivative works from them without our written permission.
12. Disclaimers and limits on liability
12.1 Marketplace disclaimer
KaziKazi provides the Service “as-is” and “as-available”. We do not warrant:
- That kazis will be completed satisfactorily.
- That Posters will pay or that Workers will perform.
- That the Service will be uninterrupted, error-free, or secure.
- The accuracy of information provided by users (including kazi descriptions, profile information, and ratings).
12.2 Liability cap
To the maximum extent permitted by Kenyan law, our total liability to you for any claim arising out of or relating to the Service is limited to the greater of:
- KES [FILL: 10,000], or
- the platform fees you have actually paid us in the 12 months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
12.3 What this section does NOT exclude
Nothing in these Terms excludes or limits any liability that cannot be excluded under Kenyan law, including:
- Liability for death or personal injury caused by negligence.
- Liability for fraud or fraudulent misrepresentation.
- Statutory consumer-protection rights you have under the Kenyan Consumer Protection Act, 2012, that cannot be waived.
12.4 Indemnity
You agree to indemnify and hold KaziKazi harmless from any claim, loss, or expense arising out of:
- Your breach of these Terms or the Community Guidelines.
- Your violation of any third party’s rights (including privacy and intellectual property).
- Your performance or non-performance of a kazi.
This applies to the maximum extent permitted by Kenyan law.
13. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Kenya.
Disputes between you and KaziKazi must first be raised by emailing legal@kazikazi.africa. If the dispute is not resolved within 30 days, either party may pursue the matter in the courts of Kenya, which have exclusive jurisdiction.
This section does not limit your statutory rights as a consumer under Kenyan law.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will:
- Update this document and bump the version number.
- Notify you in-app and/or by SMS to your registered phone number.
- For material changes affecting your rights or obligations, ask you to acknowledge the new Terms before continuing to use the Service.
If you do not accept the new Terms, you must stop using the Service. Continued use after the effective date constitutes acceptance.
15. Other legal stuff
- Severability. If any part of these Terms is held unenforceable, the rest still applies.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms. We may assign them to a successor company (e.g. in an acquisition).
- Entire agreement. These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and KaziKazi about the Service.
- Force majeure. We are not liable for failures caused by events beyond our reasonable control (natural disasters, government action, network outages, payment-provider failures).
- Notices. Legal notices to KaziKazi must be sent to legal@kazikazi.africa and [FILL: registered office postal address].
